1. Ownership of Content
All content on naianevolve.com, including text, graphics, code, tools, templates, and documentation, is owned by NAIAN LLC or used with permission. Unauthorized reproduction, distribution, or modification of Naian content is prohibited. For permitted uses, see our Terms of Service §7.
2. DMCA Safe Harbor & Takedown Policy
NAIAN LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on our services infringes your copyright, you may submit a takedown notice to our Designated DMCA Agent as described below.
3. How to Submit a Takedown Notice
To be valid under 17 U.S.C. § 512(c)(3), your written notice must include all of the following:
- Your signature — a physical or electronic signature of the person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work — a description of the copyrighted work you claim has been infringed, or a representative list if multiple works are at issue.
- Identification of the infringing material — a description of the material you claim is infringing and its location on our services (URL or sufficient detail to allow us to locate it).
- Your contact information — your address, telephone number, and email address.
- Good-faith belief statement — a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement — a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
Send your notice to our Designated Agent at the contact information in Section 5. We will respond to valid notices promptly and remove or disable access to infringing material.
4. Counter-Notice Procedure
If you believe material was removed in error or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3). Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or Miami-Dade County, Florida, if your address is outside the United States), and that you will accept service of process from the person who provided the original takedown notice.
Upon receipt of a valid counter-notice, we will forward it to the original complainant and may restore the material within 10–14 business days unless the complainant files a court action.

6. Repeat Infringer Policy
In appropriate circumstances, NAIAN LLC will terminate accounts or access of users who are repeat infringers of intellectual property rights.
7. Misuse of DMCA Process
Submitting a knowingly false DMCA notice or counter-notice may expose you to liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f). Submit notices only in good faith.
